1. Who we are and when these Terms apply
MySafeCard is a product owned and operated by Artha Tech Solutions ("we", "us", "our"), a sole proprietorship based in Hyderabad, Telangana, India.
These International Terms of Service ("Terms") apply if you live in the United States, Canada, the United Arab Emirates or Singapore (each a "Supported Country") and use the MySafeCard mobile app or website (mysafecard.in) (together, the "Service"). The country you choose when you sign up, or the country you set on a card, decides which set of terms applies to you. If you give us a country you do not actually live in, you are still bound by the terms for the country where you live.
The Service is not currently offered to people living outside India and the Supported Countries.
2. Accepting these Terms
By creating an account or using the Service, you agree to these Terms and to our International Privacy Policy. If you live in the United States, our Consumer Health Data Privacy Policy also applies. If you do not agree, do not use the Service.
3. What MySafeCard does
MySafeCard lets you create a digital emergency card that holds information you choose to enter, such as your name, photo, blood group, allergies, medical conditions, medications and emergency contacts. Each card has its own web link and QR code. Anyone who opens the link or scans the QR code can see the card in a web browser, without an app or an account. The card is meant to help a first responder or bystander learn who you are and whom to call if you cannot tell them yourself.
You can also make a card for a pet (a "pet card"). Whoever finds the pet can open its card from its tag, sticker or printed card and call you (see Section 10A).
4. Medical disclaimer — not a medical device
MySafeCard is an information-sharing tool only. It is not a medical device, diagnostic tool, clinical decision-support tool or medical advice service. It has not been evaluated, cleared or approved as a medical device by the U.S. Food and Drug Administration, Health Canada, the UAE Ministry of Health and Prevention, Singapore's Health Sciences Authority or any other regulator.
We do not check, verify or endorse anything you enter. You alone are responsible for keeping your card accurate, complete and up to date. Responders may or may not look at your card, and may choose to rely on their own assessment instead. MySafeCard must never replace professional medical judgement or emergency treatment.
MySafeCard is not a healthcare provider, health plan or healthcare clearinghouse, and is not a "covered entity" or "business associate" under the U.S. Health Insurance Portability and Accountability Act (HIPAA).
5. Emergency services
MySafeCard does not contact emergency services for you and is not connected to any emergency dispatch system. In any emergency, call your local emergency number first (see the table at the top of these Terms). Do not delay calling emergency services because of the Service.
6. Eligibility and age
You must be at least 13 years old to create an account. If you are under 18, or under the age of majority where you live if that is higher, you need the consent of a parent or legal guardian to create an account and use the Service.
A parent or guardian may create and manage a card for a child of any age (see Section 8). We do not knowingly create accounts for children under 13. If we learn that someone under 13 has an account, we will close it and delete the data.
7. Your account
You are responsible for keeping your login details safe and for everything done through your account. Do not share your password or one-time codes with anyone. If you think someone else has accessed your account, contact us straight away at support@mysafecard.in and change your password.
We support signing in with email and password, an email one-time code (valid for 10 minutes and usable once), and Google Sign-In. If you use Google Sign-In, you are responsible for the security of your Google account. You agree not to try to bypass, replay or brute-force any sign-in or security mechanism.
8. Cards for family members and others
You may create and manage a card for another person, such as a spouse, parent or child, only if you have their consent or the legal authority to act for them (for example, as the parent or guardian of a minor or the caregiver of a dependent adult).
By creating or editing a card for someone else, you confirm that you have that consent or authority for all the information you enter, including their health information and any contact details. You agree to keep the card accurate and to update or delete it promptly if that person withdraws their consent.
9. Your card is public to anyone with its link
Your card is designed to be opened by anyone who has its link or scans its QR code, including people you do not know. By creating a card, you choose to make the information on it available in that way. You decide exactly what goes on your card and can edit it at any time, or ask us to delete it (see Section 12). If a printed or shared copy of your card's link or QR code ends up with someone you did not intend, you can remove information from the card, disable it, ask us to delete it, or contact us to help.
10. Emergency contacts and approval requests
You may only list a person as an emergency contact if they have agreed to it, or if you reasonably believe they would agree. You confirm that any phone number you enter belongs to the person you name.
The app can ask an emergency contact to confirm that they agree to be listed. For contacts in India, we send the request by SMS. Approval requests expire after 24 hours.
Contacts outside India: you send the link yourself. We cannot yet send SMS to phone numbers outside India. Until we can, the app gives you an approval link that you send to the contact yourself, for example by text message or WhatsApp from your own phone. Before the link is created, the app asks you to accept the following, and we record that you did. You agree that:
- you will send the link only to the contact it was created for, at the phone number you entered, and will not forward or post it anywhere else;
- you will not open, approve or decline the link yourself, or let anyone other than the contact do so, unless the number really is your own;
- you alone are responsible for how the link is sent and used. If it is misused, for example approved by someone other than the contact, or sent to a number that does not belong to the person you named, that is entirely your responsibility and not MySafeCard's. To the extent the law allows, we are not liable for any loss arising from it, and Section 18 (Indemnity) applies; and
- a contact shown as "approved" after you shared the link yourself means only that someone opened that link and tapped approve. We cannot confirm who that person was.
Your mobile carrier or messaging app may charge for the message. This arrangement is temporary. When we can send SMS in your country, we will send approval requests ourselves, as we do in India, and may ask contacts approved through a shared link to confirm again.
10A. Pet cards and Lost mode
- Owner contacts are shown without approval. The people you list as a pet's owner contacts do not get an approval request. Their names and phone numbers are shown to anyone who opens the pet's card. You may only list someone who has agreed to that, and you confirm that each phone number belongs to the person you name.
- Lost mode. When you switch on Lost mode, the pet's card shows that the pet is lost, together with any message you write. Do not put anything in that message you would not want a stranger to read. Switch it off once the pet is home.
- We don't find or return pets. MySafeCard only shows the card to whoever opens it and tells you that it was opened. We do not look for lost pets, contact finders for you, or guarantee that anyone will open the card, call you or return the pet. To the extent the law allows, we are not liable for the loss of, or any harm to, a pet, or for anything a finder does.
- Not veterinary advice. A pet card is not veterinary advice or a veterinary record. Anything you enter about health, medication or vaccinations is your own information, which we do not check.
- Microchips and registration. A pet card does not replace a microchip, a licence or any registration your local law requires.
11. Printed cards
We print and ship physical cards only to addresses in India. We do not print, sell or ship physical cards to the Supported Countries.
Where the Service lets you download a printable copy of your card (this may be a paid feature; see Section 12), you may print it, or have a printer of your choice print it, for your own personal, non-commercial use or for the person the card belongs to. You understand that:
- we are not responsible for the quality, durability, materials or accuracy of any card printed by you or by a third party, or for how that printer handles your information;
- you must not change the QR code. A QR code that has been altered, resized below a readable size or printed poorly may not scan;
- the QR code always opens your current card, but the text printed on a card cannot change. If you update your card, the printed text may become out of date, so reprint it and destroy the old copy; and
- deleting a card in the app does not affect printed copies. You are responsible for destroying them.
12. Free and Plus plans
In the Supported Countries, every card is live on the Free plan as soon as you make it. You can buy Plus (for a pet, "Pets Plus") for a card, one year at a time. We show you the price in your local currency, and what each plan includes, before you pay.
- Free: people who open the card see its main details and one emergency contact, and you are told when the card is opened. Free costs nothing and has no end date.
- Plus: people who open the card see everything you added and up to five contacts; you can have location alerts; and you can download print-at-home files with the card's own QR code (such as an ID card, stickers and, for pets, tag designs). The exact list is shown in the app before you pay.
- One card, one year, no automatic renewal: Plus covers one card for one year from the payment. Paying again before it ends adds another year. We never charge you automatically. We remind you about 30 and 7 days before Plus ends.
- When Plus ends: the card stays live on the Free plan. Nothing you entered is deleted, its QR code and link keep working, and Plus details are simply no longer shown to people who open it. Print-at-home files you already printed keep working too.
- Payments: processed by Razorpay (Razorpay Software Private Limited, India). We never see or store your card or bank details. Your bank may charge foreign-transaction or currency-conversion fees.
- Editing a card: you can edit everything on a card at any time, also after you pay, including the name, photo, blood group and emergency contacts. A card's QR code and link never change, so they always show its latest details. If you change something that's printed, it's up to you to print the card again.
- No refunds: Plus starts as soon as you pay, so payments are non-refundable, except where we charged you in error or the law of the country where you live gives you a right to a refund.
- Deleting a card: cards are deleted by our team, so a card is never deleted by mistake. You can ask for it at any time from the app (Delete on the card) or by emailing support, and we'll email you once it's done. Deleting a card ends any Plus time left on it, with no refund, and a deleted card can't be restored. Plus on another card needs its own payment.
Before you pay, we ask you to check the card's details and to confirm the refund terms. Nothing in this section takes away any right you have under the consumer law of the country where you live.
13. Emails and notifications
We send emails that are needed to run your account, such as sign-in codes, welcome messages, card reminders, security notices and notices of material changes to these Terms or our Privacy Policy. You cannot turn these off while you have an account.
We send newsletters and other promotional emails to users in the Supported Countries only if you have agreed to receive them. Every such email includes a link to unsubscribe, and you can change your choice at any time in Account Settings. Occasional emails about changes to how the Service works are not promotional and include a one-click unsubscribe.
The app may send push notifications, for example when your card is scanned or an emergency contact responds. You can turn these off in your device settings.
14. Intellectual property
The MySafeCard name, logo, card designs, software and other materials belong to us or our licensors. We give you a limited, personal, non-exclusive, non-transferable and revocable licence to use the Service in line with these Terms. You may not copy, modify, distribute, sell or reverse-engineer any part of the Service, except as the law allows.
The information you put on your cards remains yours. You give us a limited licence to store, display and process it only so that we can provide the Service to you.
15. Things you must not do
You must not: enter information you know is false or misleading; impersonate anyone; try to access or change other users' data; use the Service for anything illegal; interfere with or try to get around the Service's security; abuse rate limits or redemption codes; or use the Service to send spam. We may suspend or close accounts that break these rules.
16. Availability of the Service
We work to keep the Service available and accurate, but, to the extent the law allows, it is provided "as is" and "as available". We do not promise that it will always be available, error-free or that a card link, QR code or NFC tag will always work, for example during a network outage or if your phone has no signal. We may change, suspend or stop the Service. If we plan to stop the Service permanently, we will try to give you reasonable notice so that you can save your information.
17. Limitation of liability
To the maximum extent permitted by the law that applies to you, we are not liable for any indirect, incidental, special or consequential loss, or for any loss arising from: any medical emergency or its outcome; inaccurate, out-of-date or incomplete card information; a QR code, NFC tag or printed card that fails or is damaged; a responder not seeing or not relying on your card; data loss; failed delivery of emails, notifications or approval messages; or what an emergency contact decides to do.
To the same extent, our total liability to you for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose and (b) US$50 (or the equivalent in your local currency).
Nothing in these Terms limits or excludes any liability that cannot legally be limited or excluded, including liability for death or personal injury caused by our negligence, for fraud, or under consumer guarantees and other rights given to you by the law of the country where you live.
18. Indemnity
To the extent permitted by the law that applies to you, you agree to compensate us for reasonable losses and costs (including reasonable legal fees) that we incur because of a third-party claim arising from information you entered without the right to do so, or from your breach of these Terms.
19. Governing law and disputes
If you have a problem, please contact us first at support@mysafecard.in. We will try to resolve it informally within 30 days.
These Terms are governed by the laws of India, and the courts of Hyderabad, Telangana, India have jurisdiction. However, if you are a consumer, you also keep the protection of any mandatory laws of the country, state or province where you live, and you may bring a claim in the courts there if those laws give you that right. The country-specific terms in Section 20 explain how this applies in each Supported Country.
20. Country-specific terms
If anything in this section conflicts with the rest of these Terms, this section applies to residents of the country concerned.
United States
- Small claims. Either you or we may bring an individual claim in a small-claims court in the U.S. county where you live, if the claim qualifies.
- State law. Some states do not allow certain disclaimers or limits on liability (including for implied warranties or incidental or consequential damages). In those states, those parts of Sections 16 to 18 apply only to the extent that state law allows.
- California residents. Under California Civil Code Section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
- Health data. If you live in Washington, Nevada or Connecticut, or your health data is collected in any of those states, our Consumer Health Data Privacy Policy describes your additional rights.
Canada
- Consumer protection. Nothing in these Terms limits your rights under the consumer protection laws of your province or territory.
- Quebec. If you are a consumer in Quebec, Sections 17, 18 and the choice of law and courts in Section 19 apply only to the extent permitted by the Consumer Protection Act (Quebec) and the Civil Code of Québec. You may bring a claim before the courts of Quebec, and any clause that the Act does not allow does not apply to you.
- Language. These Terms are available in French and English. Both versions have equal force. Les présentes Conditions sont offertes en français.
United Arab Emirates
- Consumer protection. Nothing in these Terms limits your rights under Federal Law No. 15 of 2020 on Consumer Protection or other mandatory UAE law.
- Emergency numbers. Ambulance 998, Police 999, Civil Defence (fire) 997.
Singapore
- Consumer protection. Nothing in these Terms limits your rights under the Consumer Protection (Fair Trading) Act 2003 or other mandatory Singapore law. You may bring a qualifying claim before the Small Claims Tribunals of Singapore.
- Third-party rights. No one other than you and us has any right under the Contracts (Rights of Third Parties) Act 2001 to enforce these Terms.
- Emergency numbers. Ambulance and Fire 995, Police 999.
21. Recording your consent
When you create an account or first sign in, we record that you accepted these Terms and our Privacy Policy, together with any separate health-data consents. The record includes your user ID, email address, the date and time, the version of the Terms you accepted, the country you selected, your device platform and your sign-in method. We do not record your IP address. See our Privacy Policy for how long we keep it.
22. Changes to these Terms
We may update these Terms. For material changes, we will tell you by email and in the app at least 30 days before they take effect, unless a change is needed sooner for legal or security reasons. If you do not agree to a change, you can close your account before it takes effect. If you keep using the Service after a change takes effect, you accept the updated Terms.
23. General
If any part of these Terms is found to be unenforceable, the rest stays in force. If we do not enforce a right straight away, we have not given it up. You may not transfer your rights under these Terms without our consent. We may transfer ours to a business that takes over the Service, and that does not reduce your rights. These Terms, our Privacy Policy and any terms you agree to for a paid feature are the whole agreement between you and us about the Service.
